These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "your") and MediaClub ("MediaClub", "we", "our", or "us"). The Terms govern your use of the services provided on or through mediaclub.app (the "Platform"). By registering for an account and/or using the MediaClub Services, you agree to be bound by these Terms, including any additional documents or terms referenced herein.

If you do not accept these Terms, you must not register for an account or use the Platform or any MediaClub Services.

1. INFORMATION ABOUT OUR AGREEMENT WITH YOU
1.1 About MediaClub
MediaClub is an all-in-one media marketplace designed to connect media creators and businesses across the Middle East. Our platform allows creators to showcase their portfolios, list services, and engage with clients for potential collaborations. At this stage, the platform is in its onboarding phase, which allows users to create profiles, upload portfolios, and list services. The full commercial functionality of the platform, including financial transactions, will be enabled upon the official launch.
1.2 Acceptance of Terms
By creating an account with MediaClub, you are entering into a legally binding agreement with us. These Terms govern your use of the MediaClub Services, which include the ability to:

Create a profile

Upload a portfolio (photos, videos, etc.)

List services and provide pricing details

Access pre-launch features of the Platform

You are encouraged to read these Terms carefully, along with any other documents referenced herein. If you do not fully understand these Terms, please refrain from registering for an account or using the Platform.

1.3 Additional Documents
The Terms refer to several important documents that also govern your use of the MediaClub Services. These documents include:

Privacy Policy: Explains how MediaClub collects, uses, and processes your personal information.

Cookie Policy: Details our use of cookies and similar technologies.

Content Guidelines: Sets forth the rules for uploading and sharing content on MediaClub.

Fee Structure (to be updated post-launch): Describes the fee structure, once transactions are fully operational.

By using the Platform, you acknowledge that you will be bound by and will comply with all applicable policies and agreements, including these Terms and any updates.

2. ELIGIBILITY
2.1 Eligibility Criteria
To be eligible to register for an account on MediaClub and use the Platform, you must meet the following requirements:

Legal Capacity: You must be an individual, corporation, legal entity, or other organization with full authority and capacity to enter into and comply with these Terms.

Age Requirement: If you are an individual, you must be at least 18 years of age or the legal age in your jurisdiction to create an account and enter into a binding agreement.

Jurisdiction: You must not be located in or a resident of a country where the provision of MediaClub Services is prohibited by law.

If you do not meet these criteria, you may not register for an account or use the Platform.

3. ACCOUNT CREATION AND USE
3.1 Account Information
To create an account on MediaClub, you must provide accurate and complete personal information, including your name, email address, and any other information necessary for the platform. You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify MediaClub immediately if you become aware of any unauthorized access to your account.
3.2 Profile and Portfolio
Once registered, you will be able to create a profile and upload your portfolio, including photos, videos, and descriptions of your work. You are responsible for ensuring that all content you upload is original, lawful, and compliant with MediaClub’s content guidelines.
3.3 Service Listings and Pricing
As part of your profile, you may list services that you provide, including pricing information. These service listings are for informational purposes only during the onboarding phase. MediaClub is not responsible for any transactions or commitments made through these listings until the full commercial functionality is enabled.
3.4 Content Guidelines
You agree to adhere to MediaClub’s Content Guidelines, which prohibit the upload of any content that:

Infringes upon the intellectual property rights of others.

Contains offensive, defamatory, or harmful content.

Violates any applicable laws or regulations.

MediaClub reserves the right to remove any content that does not comply with these guidelines.

4. LIMITATION OF LIABILITY AND DISCLAIMERS
4.1 Disclaimer of Warranties
The MediaClub Platform is provided "as is" without any warranties, express or implied. MediaClub does not warrant that the Platform will meet your requirements or be available uninterrupted or error-free. You acknowledge that you use the Platform at your own risk.
4.2 Limitation of Liability
To the fullest extent permitted by law, MediaClub shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, including but not limited to damages for loss of profit, goodwill, or data.
4.3 No Financial Transactions
During the onboarding phase, MediaClub does not facilitate any financial transactions between users. Any service listings or pricing information provided are non-binding and subject to change. MediaClub will not be responsible for any agreements, financial or otherwise, made during this pre-launch phase.
5. MODIFICATION OF TERMS
MediaClub reserves the right to modify or update these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this document. Any modifications to these Terms will be effective upon posting, and your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
